Establishing Child Support
The statutory guidelines in Colorado, C.R.S. 14-10-115, were set to ensure that children receive a fair and appropriate amount of support from their parents. The primary factors that come into play include:
- The total income of each parent
- How many children are involved
- Additional basic needs related costs such as healthcare, food or childcare
- The amount of time each parent has with the children
While every situation is unique, in most cases, the parent with the least visitation time will be paying child support. In cases with large income disparity, the court may take other factors into consideration to determine a fair child support amount.
Modifying Child Support
When the court establishes a child support amount, an official court order will be put into place. Once this happens, child support must be paid until the child turns 19 or graduates from high school, whichever comes first. However, throughout the duration of the child support obligations, parents can petition to modify the amount of child support paid if one or both parents experience a change in financial status. This modification process can be complicated, so it is important to hire an experienced attorney to assist you in this matter whether you are requesting a modification or you’ve received notice that the other parents wishes to modify the amount.
